The Act and Regulations

The Broadcasting and Radio Re-Diffusion Act is the principal statute governing the regulation of broadcast media and subscriber television in Jamaica. It is supported by the Television and Sound Broadcasting Regulations.

The Act establishes the legal context for the operation of licensed services, and specifies the authority of the principal regulatory bodies, namely the Minister of information and the Broadcasting Commission.

The Act details the following:

  • The requirement of a licence for the operating of broadcast and STV systems
  • Eligibility of applicants for licences
  • The process and conditions for applying for a licence
  • Terms of licences
  • The process of appeal in the event of non-grant of a licence and
  • Constitution and procedure for the Appeal Tribunal
  • Responsibilities of the licensee
  • Offences for operating without a licence, subscribing to an illegal subscriber television operator, and tampering with the operations of a licensed system
  • Protocols for the Commission and the Minister in dealing with licensee matters
  • Mandate and constitution of the Commission, and operation of its Secretariat.

The Regulations specify the programming, customer service and administrative standards and guidelines to which licensees are bound, as well as the technical standards for subscriber television licensees. A copy of application forms for commercial broadcasting and subscriber television licences are included in the Regulations.

Broadcasting and Radio Re-diffusion Act and Television and Sound Broadcasting Regulations are printed by Jamaica Printing Office, and can be purchased from that agency, which is located at 77½ Duke Street, Kingston.

Regulations may also be bought from the Commission’s Secretariat. Photocopies of the Act are also available.
